There has been a change in the application process for the Spanish Foreigner Identification Number (NIE - número de identidad de extranjero). To apply for an NIE number, a notarized copy of the identity card/passport and a notarized special or general power of attorney from the lawyer are required, among other things.

Previously, it was possible to have the power of attorney and the copy of the identity card/passport certified by a foreign - i.e. non-Spanish - notary. From now on, this is no longer the case. From now on, the certification of the copy of the identity document or that of the power of attorney must be done by a Spanish notary, it is no longer possible to have both certified by a foreign notary.

There is, however, one exception to this rule: Certification of the power of attorney and copy of the identification document by a non-Spanish notary is still permissible if proof is presented that the client was actually in Spain at the time the application was filed. This can be proven in particular by presenting an airline ticket.

So the application for the NIE number can no longer be done completely without your presence in Spain.
